Terms of Service

These Terms of Service ("Terms") govern your use of the WataDash website, apps and services operated by Wata Dash Ltd ("WataDash", "we", "us"). By creating an account or placing an order you agree to these Terms. If you do not agree, do not use the service.
1. Who we are and what WataDash is
Wata Dash Ltd is a company operating in Jamaica with its place of business at Wata Dash Ltd, Kingston, Jamaica.
WataDash is a marketplace and logistics platform. We connect customers with independent water suppliers, distribution hubs and independent delivery drivers. We do not produce, bottle or treat water, and we do not employ the drivers who deliver it. Suppliers are responsible for the quality, safety and labelling of the water they sell. Drivers are independent contractors responsible for their own vehicle, licence, insurance and tax obligations.
Where a supplier or driver causes loss, our role is to investigate, mediate and where appropriate refund the order under our Refund and Cancellation Policy.
2. Eligibility and your account
You must be at least 18 years old and legally able to enter a contract to use WataDash.
You must give accurate registration details, keep your password confidential and tell us promptly of any unauthorised use. You are responsible for activity carried out under your account.
We may suspend or close an account that is used fraudulently, abusively, to harass drivers or supplier staff, or in breach of these Terms.
3. Placing an order
An order is an offer to buy the listed items from the supplier shown at checkout. The contract for the water itself is formed between you and that supplier when the order is accepted. WataDash arranges payment, allocation to a hub, route planning and delivery on the supplier's behalf.
Stock, opening hours and delivery windows shown in the app are estimates provided by suppliers and hubs. If an item cannot be filled, we will contact you to substitute or refund it.
Delivery is only available inside the service zones shown at checkout. Estimated arrival times are estimates, not guarantees; weather, road conditions, traffic and water availability can affect them.
4. Prices, fees and payment
All prices are shown in Jamaican dollars (JMD) and the total displayed at checkout is the amount payable. It is made up of the item price, any bottle deposit, a delivery fee based on distance, and a service fee. Any promotional discount is shown before you pay.
WataDash is card-only. We do not accept cash on delivery. Card payments are processed by Stripe. We never see or store your full card number; Stripe holds it as the payment processor.
Your card is charged when the order is placed. The order is only released to a hub once payment is confirmed. If payment fails, the order is cancelled automatically.
We may change prices, fees or promotions at any time; changes never apply retroactively to an order that has already been paid for.
5. Bottle deposits and exchange
Some containers are returnable and carry a refundable deposit. If you hand an equivalent empty bottle to the driver at delivery, no deposit is charged for that bottle and your bottle balance stays level.
If you do not exchange an empty, the deposit is charged and recorded against your account. Returning a clean, undamaged empty on a later delivery credits that deposit back.
Bottles remain the property of the supplier. Deposits are not a purchase price and are not refundable for bottles that are missing, contaminated or damaged beyond reuse.
Your current bottle balance is always visible in your account.
6. Delivery, PIN verification and failed deliveries
Each order has a 4-digit delivery PIN shown in your account. The driver only completes the delivery once you give them the PIN, and bottle counts are recorded at the same time. Do not share the PIN before the water is physically handed over — doing so is at your own risk and may prevent a refund.
Someone aged 18 or over must be present to receive the delivery. If nobody is available, the driver will attempt contact and wait a short period before marking the delivery as failed.
If a delivery fails because we, the supplier, the hub or the driver could not perform it, you are refunded in full. If it fails because nobody was available, the address was wrong or access was refused, we may retain the delivery fee to cover the trip.
Where a delivery address is unsafe or inaccessible, a driver may refuse the drop and report it to us.
7. Cancellations and refunds
You may cancel and receive a full refund at any time before a driver claims the route carrying your order. After that point the items are refunded but the delivery fee is retained, because the trip has already been dispatched.

8. Acceptable use
You agree not to: misuse the service or the delivery PIN system; place orders you do not intend to pay for or receive; abuse, threaten or discriminate against drivers, hub staff or our team; attempt to access accounts, routes or data that are not yours; scrape, reverse engineer or disrupt the platform; or use WataDash for anything unlawful.
We may suspend access, cancel orders and report conduct to the authorities where these rules are broken.
9. Ratings, reviews and content
You may rate deliveries and leave comments. Content must be honest and must not be defamatory, discriminatory or obscene. We may remove content that breaches this and may use anonymised, aggregated ratings to manage supplier and driver quality.
The WataDash name, logo, software and content are owned by us or our licensors. You get a limited, revocable, non-transferable licence to use the app for its intended purpose.
10. Liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be limited under Jamaican law.
Subject to that, our total liability arising out of any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, loss of profit, or loss caused by events outside our reasonable control including severe weather, flooding, road closures, utility or water supply failures, industrial action, or failure of third-party payment, mapping or telecommunications services.
Because we are a marketplace, we are not liable for the water quality, treatment or labelling of a supplier's product, nor for the driving conduct of an independent driver, beyond our obligation to investigate, remove bad actors from the platform and refund affected orders.
11. Suspension, changes and termination
You may close your account at any time from your account settings or by contacting support. We may suspend or terminate access where these Terms are breached, where required by law, or where continuing would create a safety or fraud risk.
We may update these Terms. Material changes will be notified in the app or by email before they take effect, and the date at the top of this page will change. Continuing to use WataDash after that date means you accept the updated Terms.
12. Complaints, governing law and disputes
Raise any complaint first through our in-app support system or by emailing support@watadash.com. We aim to resolve complaints quickly under our Support Policy, and we escalate unresolved matters to a manager for review.
These Terms are governed by the laws of Jamaica, and the courts of Jamaica have exclusive jurisdiction over any dispute, except that either party may seek urgent injunctive relief in any competent court.
